Illinois Real Estate Law
Real Estate Law is an area of business law that covers an individuals rights to possess, use, and enjoy land and the permanent man-made improvements attached to the land. This includes the ability to own interests in real property, permissible interests in real property, relations between owners, relations between owners and the community, landlord and tenant relations, the right to transfer ownership of real property, and real property financing which includes deeds and mortgages.
Moreover, real estate law includes a wide variety of legal issues relating to financing, acquiring, improving, developing, managing, constructing, leasing and selling residential and commercial real property of all kinds, including:
- real estate transactions involving agent or broker representation, litigation, negotiation of mortgages, purchase and refinancing, reverse mortgages, 1031 tax-deferred exchanges, residential and commercial purchase and sale agreements, leases for residential and commercial properties such asapartment buildings, office complexes, medical building, retail shops, shopping centers, strip malls, and industrial property.
- real estate disputes, including issues over adverse possession, prescriptive easements, eminent domain, condemnation, property taxes, title and boundaries, views, trees, branches, party walls, fences, as well as nuisance, trespassing, encroachment, as well as sale disputes (e.g., breach of contract, specific performance, non-disclosure, fraud or misrepresentation).
- real estate brokerage issues, such as claims against and defense of real estate brokers and agents dealing with negligence, fraud/misrepresentation, breach of fiduciary duty, disclosure obligations, employee, brokers and independent contractor agreements, ambiguous terminology, unenforceable clauses, etc.
